*Under the understandings reached with the National Insurance Institute ("המוסד לביטוח לאומי") we must clarify that BAREKET IT LTD ("ברקת אי.טי בע״מ"), trading as NETO, acts as a manpower company (licence no. 1565) and is therefore entitled to employ workers to perform work for service purchasers (clients). Under the Order on the Classification of Insured Persons and the Determination of Employers ("צו סיווג מבוטחים וקביעת מעבידים"), NETO may employ service providers even where they do not meet every definition of an employer-employee relationship ("יחסי עובד מעביד"). However, for workers who do not meet the definition of manpower-company workers ("עובדי כוח אדם"), the National Insurance Institute may examine their status and decide whether they meet the criteria to be insured as employees or as self-employed ("עצמאי") · mainly for the purposes of benefits such as unemployment pay.
**It is important to clarify that NETO provides full social benefits by default, but the employee or the employer does not always choose that, so the employment agreement sets it out. NETO also acts in some cases under labour law and in other cases under the Order on the Classification of Insured Persons and the Determination of Employers, which varies with the nature and duration of the work, the terms of the agreement and the definitions in law; there are cases in which the employer-employee relationship exists as a three-way relationship as defined in the Manpower Contractors Law ("חוק העסקת עובדים על ידי קבלני כוח אדם").
